Terms of Service

These Terms of Service ("Terms") constitute a legal agreement between you ("User") and Tentekio LLC ("Company", "we", "us") governing your use of the FloSync software application ("Software") and the FloSync website at https://flosync.com ("Website"). By downloading, installing, or using the Software, you agree to these Terms.

1. License Grant

We grant you a non-exclusive, non-transferable, revocable license to download, install, and use the Software on devices you own or control, for personal or commercial purposes, subject to these Terms.

The Software is currently provided free of charge. We reserve the right to introduce paid features or services in the future, with reasonable notice.

2. Restrictions

You may not:

  • Redistribute, sublicense, rent, lease, or lend the Software to third parties
  • Remove or alter any proprietary notices, labels, or marks in the Software
  • Use the Software for any unlawful purpose
  • Reverse engineer, decompile, or disassemble the Software, except (a) to the extent that applicable law prohibits this restriction, or (b) to the extent necessary to exercise rights under open source licenses for third-party components included in the Software (see Section 8)

3. Intellectual Property

The Software and all related materials (including the Website, documentation, logos, and trademarks) are owned by Tentekio LLC and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, trade names, or logos.

4. Privacy and Data Collection

FloSync's core playback and scheduling features run locally, and your media/configuration data remains on your devices. If you choose to submit bug reports or crash reports, you may share diagnostic information with us to help investigate issues. We may also collect anonymized usage analytics to improve the Software.

5. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SOFTWARE WILL BE ERROR-FREE, UNINTERRUPTED, OR FREE OF HARMFUL COMPONENTS.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TENTEKIO LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SOFTWARE, REGARDLESS OF THE THEORY OF LIABILITY.

OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SOFTWARE (CURRENTLY $0).

7. Termination

These Terms are effective until terminated. We may terminate your license at any time if you breach these Terms. Upon termination, you must cease all use of the Software and delete all copies. Sections 3, 5, 6, and 9 survive termination.

8. Open Source Components

The Software includes components from the FFmpeg project, licensed under the GNU Lesser General Public License version 2.1 (LGPLv2.1). FFmpeg is dynamically linked and can be replaced by the end user in accordance with the LGPL.

The FFmpeg source code corresponding to the binaries included in this Software is available at ffmpeg.org/releases.

Nothing in these Terms restricts your rights under the LGPLv2.1 with respect to the FFmpeg components, including your right to reverse engineer those components for the purpose of debugging modifications to the LGPL-licensed libraries.

The Software may also include other open source libraries, each governed by their respective licenses. A full list of third-party licenses is available in the Software under Help > About.

9. Governing Law

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Florida.

10. Changes to These Terms

We may update these Terms from time to time. Updated Terms will be posted on this page with a revised "Last updated" date. Continued use of the Software after changes constitutes acceptance of the new Terms.
